Two former caregivers at a Michigan assisted living community are facing felony charges after a resident with dementia exited the building and froze to death.

Yahira Zamora, 21, has been charged with second-degree vulnerable adult abuse, and Denise Filcek, 45, faces one count of intentional inclusion of misleading or inaccurate information in a medical chart, according to Michigan Attorney General Bill Schuette. Both were working the overnight shift Oct. 26-27 at Crystal Springs Assisted Living Center in Grand Rapids, MI, when the incident with 85-year-old Kathryn Brackett occurred, Schuette said in press release. Crystal Springs is a Meridian Senior Living community.

On the night in question, Zamora allegedly reset an alarmed door without determining whether any residents had exited the facility, according to the attorney general. Filcek allegedly did not perform the every-30-minutes visual bed checks for which she was responsible but documented that she had done so, he said.

Each woman faces up to four years in prison or a $5,000 fine if found guilty.

Brackett’s family filed a lawsuit against the community in January. Meridian declined to comment for the media.
