The owner of an assisted living community in New York City is suing five adult children of residents for $50 million because they will not move their parents so that he can sell the property to a developer, the New York Post reports.

Haysha Deitsch, a developer and the owner of Prospect Park Residence in Brooklyn, reportedly maintains that the five women are obstructing his plans to evict the residents. The community has been accused of elder abuse and has seven wrongful death lawsuits pending against it, according to the newspaper.

As previously reported by McKnight’s, Prospect Park announced plans to close in March 2014. Deitsch agreed to sell the building for $76.5 million once all of the residents had moved out. Since then, most of the 130 original residents have moved; seven who remained in June lived in the facility’s dementia unit. At that time, residents and families accused Deitsch of defying a court order and not turning on the air conditioning in an effort to make them move out. They also said he dimmed hallway lights, provided meager meal plans and kept the facility understaffed.

In July, a judge threw out a motion to dismiss the residents’ case against Prospect Park Residence and Deitsch.
