Home care workers at Red Lion Home Care in Wynnewood, PA, claim that the home care agency cut their hourly rates during the weeks they worked overtime in order to shrink their time-and-a-half rates. This is according to a proposed class action lawsuit filed in a Philadelphia state court.

The workers were paid $13/hr. during weeks when they worked 40 hours or less. But the suit alleges that for two weeks in July, when one of the caregivers worked more than 40 hours, the paid hourly rates were  $11.12 and $10.95 for the first 40 hours, resulting in overtime rates of $16.68/hr. and $16.42/hr.

Executives for Red Lion Home Care did not respond to requests by McKnight’s Home Care Daily for comment.
