Home health aides suffered a legal setback on Friday when they lost their proposed class action accusing two New York health services companies of cheating them out of wages and benefits.

A federal judge dismissed the Employee Retirement Income Security Act claims, citing an insufficient connection or evidence of harm.

According to Judge Ann M. Donnelly of the U.S. District Court for the Eastern District of New York, the aides didn’t allege that they were denied any benefits owed under an ERISA plan.

Nor did they show that the plan was mismanaged so severely as to jeopardize their ability to receive future benefits, according to the judge.
