Sunrise Senior Living is dropping the $30 million lawsuit it filed in July against the the town council of Vienna, VA, according to the Tyson Reporter. The lawsuit alleged that the body discriminated against older adults and people with disabilities in rejecting a rezoning application and conditional use permit for an assisted living and memory care community proposed for a downtown redevelopment area.

Steven Briglia, the town’s attorney, told the Town Council last week that Sunrise had agreed to drop the case. The company’s plans to build on the site now are proceeding with the council, the media outlet reported.

“They are very happy … to move forward on that,” he said, adding that the lack of a lawsuit “will remove the cloud on that property.”

In the lawsuit, Sunrise had said the council violated the Virginia Fair Housing Law via its rejections, a claim that the town disputed.

Sunrise did not respond to a request for comment by McKnight’s Senior Living.
