The Department of Labor’s Wage and Hour Division will hold five in-person listening sessions to gather feedback and ideas related to its planned update of the federal overtime pay rule, the division announced Monday.

The regulations, issued under the Fair Labor Standards Act, implement exemptions from the overtime pay requirements for executive, administrative, professional and certain other employees.

The sessions:

  • Atlanta — Sept. 7, 10 a.m. to noon
  • Seattle — Sept. 11, 10 a.m. to noon
  • Kansas City, MO — Sept, 13, 10 a.m. to noon
  • Denver — Sept, 14, 10 a.m. to noon
  • Providence, RI — Sept. 24, 10 a.m. to noon

There is no charge to attend any session, but those interested in attending must register online. The locations of the sessions are listed at the link.

The public also will be able to comment on federal overtime requirements when the Labor Department issues its notice of proposed rulemaking, a department spokesperson told McKnight’s Senior Living on Monday. The department previously said that it expects to issue that notice in October.

Meanwhile, a Labor Department pilot program through which employers who inadvertently violate the overtime and minimum wage provisions can avoid penalties is ongoing, the spokesperson said. The Payroll Audit Independent Determination, or PAID, program was announced in March and at that time was expected to last for approximately six months.

Depending on the results, the program could become permanent, the department said in March. The spokesperson said it was too early to discuss the results.
