Members of the National Center for Assisted Living are meeting with members of Congress today in the nation’s capital. High on their list of talking points are concerns about the possible direction of a final rule targeting home- and community-based services.

The Centers for Medicare & Medicaid Services issued a final rule in 2014 that establishes requirements for the qualities of settings for eligible participants. As structured, the rule could possibly exclude many assisted living communities from the Medicaid program. Operators are seeking additional guidance from CMS to ensure the rule implementation accounts for the preferences of assisted living residents and the nature of senior living communities in response to those preferences.
