A lawsuit against a New York City assisted living facility accused by three residents of putting them in danger of contracting COVID has been dismissed.

Judge Kiyo A. Matsumoto of the U.S. District Court for the Eastern District of New York dismissed the May 2020 lawsuit against Queens Adult Care Center last month with an 18-page ruling that stated that it was not actionable under the American with Disabilities Act and the Rehabilitation Act of 1973.

Facility representatives said Wednesday that they were “gratified” by the ruling, calling the lawsuit’s allegations “without merit, misleading and false.”

“Queens Adult Care Center has consistently gone above and beyond state and federal guidelines regarding COVID-19, and we have always put resident safety and well-being first,” said a statement released by the facility. “We commend our employees for their selfless and tireless dedication during these most challenging times.”

The facility said it believes that “certain plaintiffs were ‘strongly’ encouraged to lodge baseless and extravagant claims by external parties who thought they could ultimately benefit financially.”

The residents who sued Queens Adult Care Center still live at the facility, according to the statement.
